High Ropes Oxford – Booking Terms and Conditions

1. General

1.1. These Booking Terms and Conditions apply to the booking of the High Ropes Course at High Ropes Oxford (HRO), Furze Brake woodland, Culham Oxfordshire.  High ropes Oxford is a trading name of Lasergaming Uk Limited.

1.2. No variation to these Booking Terms and Conditions shall be binding unless agreed in writing by HRO.

1.3. These Booking Terms and Conditions contain important information concerning participation by you and members of your party and, as such, you acknowledge and agree that you shall ensure that all members of your party are aware of and accept these Booking Terms and Conditions.

1.4. HRO reserves the right to make changes to the Ropes Course Activities.

1.5. Any typographical, clerical or other error or omission in any booking confirmation or other documentation issued by HRO (including any electronic documentation) shall be subject to correction without any liability on the part of HRO.

1.6. HRO complies with the requirements of the Consumer Protection (Distance Selling) Regulations 2000.

1.7. Before confirming your booking it is your responsibility that both yourself and all members of your party acknowledge and agree the contents of the terms and conditions as they contain important information regarding the participation of activities.

1.8. Only by accepting these terms and conditions can participation commence.

 

2. Safety

2.1. There are some inherent risks associated with Ropes Course Activities. The Ropes Course Activities may be physically and emotionally challenging. All participants will receive appropriate training from an instructor prior to commencing the activities.

2.2. HRO reserves the right to refuse admittance to the Ropes Course Activities or to remove a participant from the Ropes Course Activities should it deem necessary to do so. This includes a participant who does not comply with the safety rules and advice and the safety system or who is deemed to be under the influence of alcohol or drugs.

2.3. All participants must be reasonably fit and healthy, a minimum of 1.40m tall.

 

2.4. All participants are required to wear a full body safety harness provided by HRO and fitted by an instructor.

2.5. The Ropes Course Activities may be physically demanding and require a degree of agility, strength and stamina. If participants are in any doubt as to whether they should attempt the Ropes Course Activities they are advised to view the Ropes Course before booking. If participants have medical concerns they are advised to consult their doctor in advance. Participants will be required to certify that they do not suffer from any medical condition which would make it more likely that they would be involved in any incident which could result in injury to themselves or others (including pregnancy).  If you have had a operation in the last 6 months then you will need a doctors/consultants letter to confirm your fitness for this adventurous activity.

2.6. All participants are required to act responsibly and courteously at all times and to respect other participants. HRO shall be entitled to prevent any person from undertaking or completing the Ropes Course Activities in the event of unsuitable behaviour by a participant.

2.7. Participants must be dressed appropriately (see clause 5) and HRO reserves the right to refuse admittance to the Ropes Course Activities by any participant who is not appropriately dressed. No refunds will be given.

2.8. The Ropes Course Activities will remain open in most weather conditions (but not in gales, lightning, heavy ice or snow).

2.9. No refunds or compensation will be payable by High Ropes Oxford in the event that any participant is not permitted to, or decides not to, undertake or complete the Ropes Course Activities for the reasons set out in this clause.

2.91. Upon completion of the activities at High Ropes Oxford, it is the participants responsibility to return all safety equipment to the Reception shelter and ensure that it is handed to one of our staff members or instructors, failure to do so will incur a £350 payment per set of no returned equipment.

 

3. Booking Confirmation

3.1. No booking shall be deemed to have been accepted unless accepted in writing by HRO OR LASERGAMING (this shall include HRO email confirmation of booking).

3.2. These Booking Terms and Conditions incorporate a HRO Acknowledgement of Risk Form. You and each member of your party over the age of 18 will be required to sign the Acknowledgement of Risk Form before being allowed to undertake the Ropes Course Activities. Those under the age of 18 shall only be permitted to partake if the High Ropes Oxford consent form is signed by a parent or legal guardian or other authorised to do so.  No form – No Play!

 

3.3. You must advise HRO as soon as possible of any mistake in HRO booking confirmation. HRO shall take reasonable care to ensure that your and your party’s session commences at the time booked and it shall be the responsibility of each participant to ensure that they arrive in sufficient time. Late arrivals may not be permitted to undertake the Ropes Course Activities and no refunds or compensation will be payable in such circumstances.

You must be present on site ready for kit up and harnessing 20 minutes before your session start time.  The start time on your confirmation is for your safety briefing start time which starts promptly.  You must be kitted and harnessed up 20 minutes prior to the briefing commencing.  If you arrive after the kit up time we will try and accommodate you, but this may not be possible but if you arrive after the session start time when the safety briefing has commenced we regret we can not allow you to participate and no refunds will be given.   Please note the power fan experience is only open at certain times of the day, and each group is given a allocated time where they can have a go. In order to participate in the activity you will need to be in the power-fan area when it opens.  We can not refund any participants who miss the session slot allocated.

3.4. Group Bookings (A party of six or more individuals) is subject to additional terms in Section 9.

3.5. The activities comprise of a challenging high ropes course and participation is not without risk.  Our Unique Continuous Self Belay system the Faszinatour smart belay, Guarantees safety due to the participant not being able to unintentionally un-clipboth carabiners and disconnect from the course which could result in a fall.

3.6. A safety briefing will be conducted before commencement of the course.  Each participant will be assessed during the safety brief element, if they complete the first 3 obstacles incorrectly, they will be asked to repeat, if they still fail to complete this part safely (they have not understood or cannot understand the safe system of completing the course on their own), they will be removed from the course and no refunds given.

3.7. After the safety briefing, participants will not be directly supervised by an instructor.  A participating adult must accompany under 18 year olds.  One adult is allowed to supervise up to 4 children.  Participating adults must sign the Acknowledgement of risk form stating that he or she will accept responsibility for the safety of him or herself and for the supervision of children in her or her care.  If possible, we recommend another adult supervising the group on the ground.

3.8. Participants must be able to see similar distances to those required to drive a car in order to be able to complete the course and to supervise any under 18’s in their care.  Consequently, short or long sighted participants must ensure that they wear contact lenses or prescribed glasses.

3.9. All Participants must be reasonably fit and healthy and a minimum of 1m 40cm, at least 10 years old and must weigh less than 120Kg.  The size of the harness used on the course dictates the size of the customer we can allow to safely use the course, If you have any concerns regarding this, please call 01865 822305.  If on the day any of the participants do not meet our height/weight and medical requirements, they will not be able to participate on the course and no refunds will be made.

 

4. Cancellations

 

4.1. You will be entitled to cancel your booking without charge (with exception of group bookings and booking fee/credit card charges) 28 days prior to activities. Once you have booked your session and secured with payment the tickets are removed for sale from our booking system.  These have been removed to secure your place on the course and prevent others purchasing that place.  If you cancel your session within 28 days of your session no refunds will be made, please note we can not offer refunds or change of sessions for recent or on the day illness’s or non-attendance for any other reason.  This also includes people who can’t make it, on the day illness’s, last minute football matches etc.  If your reserved/booked participant numbers do not attend the activity total cost will still apply.   The booking fee and credit card charges are also non refundable and will be deducted from the total amount refunded.

Please note we do NOT offer refunds or change sessions for on the day illness’s.  Once you have paid for your place(s), they has been removed from sale off our booking system and others have been prevented from purchasing the session.  The places are transferable to other people for the same date and time.

If you have booked for 6 people or more, group cancellation conditions will apply.

For Bookings of 6 or more 28 days notice prior to your session must be given for cancellation and a full refund to be given excluding charges as well as the above terms and conditions.  If you cancel you session within 28 days of the session no refunds will be made.

4.2. HRO shall be entitled to cancel your booking at any time. In the event that HRO decides to cancel your booking, for example due to bad weather conditions it will use reasonable measures to notify you as soon as possible. You shall be entitled to re-book another date subject to availability in the event of cancellation under this clause but no other compensation will be payable and no refunds will be made.

4.3. In the event that it proves necessary to close the Ropes Course Activities for reasons beyond the control of HRO and in circumstances where your party has commenced participation in the Ropes Course Activities, you shall not be entitled to any refund (in part or in whole).
In such circumstances HRO may, but will not be obliged to, offer alternative dates or times at no additional cost.

Bad weather, Rain, light snow and patchy showers are acceptable conditions that do not require cancellation.  We are an all weather provider, and continue subject to access to the site.  In the event thunder and lightning occurs during the session, the session will be stopped, climbers removed from the course, all participants will be taken to a safe area until the bad weather dispersers. We will then put everyone back on the course and  The session will then continue as normal. In the event that weather is so severe that the session has to be cancelled by us, (severe gales, severe snow storms) we will notify you at our earliest convenience and re-schedule your session for another time.  If our venue is operating in adverse weather conditions as normal, and can provide a safe well managed session, in the event you choose to cancel your session, your session will not be re-scheduled, the full balance will still need to be paid and no refunds will be given.

  • Site closure

Under circumstances out of our control, including but not limited to; extreme weather or other natural damages to our site, or other events which may create unacceptable risk to health and safety or the inability to run an acceptable standard of session, we reserve the right to cancel your booking and offer an alternative date.  Our activities are all-weather sports and activities and will normally proceed regardless of weather conditions. In adverse weather conditions you should assume your booking will proceed unless directly advised by us otherwise. We will do our best to keep the site open and check access routes are clear. In the event that bad weather forces the site to close – such as severe snow, we will inform you at the earliest opportunity and re-schedule the booking for another date.   If you can provide us with a mobile number as well at the time of booking this will be useful in the event we needed to contact you on the day of your session.

4.4. Group Bookings (A party of six or more individuals) is subject to additional terms in Section 9.

 

5. Clothing

5.1. It will be the responsibility of all participants to ensure that they are dressed appropriately and HRO advises participants to wear clothing appropriate for the weather conditions and which they do not mind being damaged. In particular the following restrictions will apply:

 

5.1.1. participants may not undertake the Ropes Course Activities in sandals or unlaced shoes (training shoes or walking boots are advised)

5.1.2. long hair must be tied back

5.1.3 scarves are not permitted to be worn, No chewing gum or food on the course

5.1.4. jewellery and body piercings must be removed or taped over

5.2. HRO will not be responsible for any damage to or loss of clothing or other personal items of persons resulting from participation in the Ropes Course Activities.

 

6. Price and Payment

6.1. Subject to any terms agreed in writing between HRO and you, our charges will be calculated at our current rates and payment in full shall be due at the time of booking. Payment may be made by debit or credit card either on line or by telephoning the booking line: 01865 822305.

6.2 Prices are subject to change and a booking fee of £1.00 is charged on all bookings to cover bank charges for processing the card.  An additional 2.5% charge is payable for bookings of 6 tickets or more that pay by credit card.

 

7. Refunds

Payments made by debit or credit card will be refunded to the same card.  Group bookings are subject to a £25 admin fee, please see below. The booking fee and credit card charges are also non refundable and will be deducted from the total amount refunded.

 

8. Liabilities

8.1. Except as otherwise provided in these Booking Terms and Conditions HRO shall not be responsible for the loss or damage to any property or to any person arising from the booking of or participation in the Ropes Course Activities.

8.2. Parking facilities are available at the site, and any vehicle and its contents is left at the owner’s risk.

 

8.3. Except as otherwise provided in these Booking Terms and Conditions any liability of HRO  shall be limited to the refund of any charges paid to HRO.

8.4. Nothing contained in these Booking Terms and Conditions is intended to nor shall limit the liability of HRO in respect of death or personal injury caused by the negligence of HRO or of its employees, agents or contractors.

 

9. Group Bookings

 

9.1. A party of six or more individuals will constitute a group booking and will be subject to the following additional terms;

9.2. All payments must be made in full before the activities begin. Payment made by credit or GPC card incur an additional 2.5% transaction fee. Payment by credit or GPC card will incur an additional 2.5% transaction fee

9.3. For Bookings of 6 or more 28 days notice prior to your session must be given for cancellation and a full refund to be given excluding booking fee, admin charge and credit card fees – please see 9.7.  If you cancel you session within 28 days of the session no refunds will be made.

9.4. We require 28 days notice for any drop in numbers or cancellations, a group cancelling or drop in numbers within 28 days of the activity will be charged in full.

9.5. If a discounted price is offered this is based on group size and date given. Should you reduce your group size at any time prior to the event your booking will be re-priced accordingly and further charges may apply.

9.6. If your reserved participant numbers do not attend the activity total cost will still apply. Extra participants may be added subject to availability and additional costs.

9.7. Cancelling the session or Changing course or activity dates will result on an administration fee of £25 being charged to cover transaction costs, card fees, bank and admin costs.  Refunds will also result in a further refund charge of £2.50 per transactions to cover bank fees.  The booking fee and credit card charges are also non refundable and will be deducted from the total amount refunded.

9.8. For special offers, please read the terms and conditions of offer.  If the offer that you have booked is for selective days only, and you choose a date that is not indicated as a offer day, you will be contacted to  pay ther difference for the session.  If you would like to add people on to your booking after a offer has ran out, you will be required to pay full price for any additional people booked on.  For the Hen and Stag offer, the 11th place will be free on bookings of 10 or more.  If your numbers decrease the offer will be withdrawn.

 

10. Miscellaneous

10.1. If any of these terms are determined to be illegal, invalid or otherwise unenforceable it shall be severed and deleted from these terms and the remaining terms shall endure, remain in full force and continue to be binding and enforceable.

10.2. Nothing above shall confer on any third party any benefit or the right to enforce any of these Booking Terms and Conditions.

10.3. These Booking Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.

10.4.  Persons are not allowed to bring their own equipment to use on the course, under any circumstances.

10.5 Gift Vouchers: Gift vouchers cannot be used in conjunction with any other offers or existing bookings.  Each voucher will detail when it can be used by and the validation times and terms.
